1. Who We Are and When These Terms Apply

This website, atlst.com, is operated by ATLST BRANDS LLC, doing business as ATLST (“ATLST,” “we,” “us,” or “our”). These Terms of Service govern your use of our website and purchases through our online store, together with the policies linked here and any terms disclosed for a particular order.

By using our website or placing an order, you agree to these Terms to the extent permitted by applicable law. To place an order, you must be at least the age of majority where you live and legally able to enter a binding agreement. If you act for a business, you must be authorized to do so. A separate written agreement may govern a wholesale, corporate-gifting, or other business arrangement.

2. Permitted Use of Our Website

You may use our website for legitimate shopping, account management, and business inquiries. You agree to provide accurate information and use the website lawfully. You may not misuse the site, interfere with its security, or use it to violate another person’s rights.

3. Product Information

We aim to describe and display our products accurately. Colors and textures may appear different because of lighting, photography, and screen settings. Sizes, weights, and other measurements are approximate when identified as such. Follow the product’s care instructions.

Availability may vary by color, size, and destination. We may update our assortment or discontinue products, but this does not remove our obligations for orders already placed or any express product promises and applicable consumer rights.

4. Prices, Payments, and Promotions

Prices are in U.S. dollars unless stated otherwise. The applicable order total, taxes, and shipping charges are shown at checkout before you pay. You authorize payment using the method selected at checkout. Payment services may have their own terms.

Prices and promotions may change for future purchases. A later price change does not by itself change an existing order. Any promotion-specific eligibility requirements, dates, exclusions, or limits disclosed with the offer also apply. Comparison values, if shown, are explained on the relevant product page and are not a statement of ATLST’s former selling price unless specifically identified that way.

5. Orders, Availability, and Errors

We send an email acknowledging your order. Orders remain subject to payment verification, product availability, and checks for fraud or misuse. We may reasonably limit quantities or decline or cancel an order because of suspected fraud, a material pricing or listing error, stock limitations, an unsupported delivery address, or other lawful grounds.

If we cannot fulfill an order or a material correction is needed, we will contact you using the information supplied at checkout. We will not charge an increased price without your consent. If we cancel an unshipped item, we will promptly refund the amount paid for it, including applicable taxes and shipping charges. Nothing in this section limits the cancellation and refund rights described below.

6. Presales, Preorders, and Cancellations

Presale and preorder items are not available for immediate shipment. Review the estimated shipping date or window on the product page and at checkout before buying. For presales paid at checkout, payment is collected before shipment. Any different payment arrangement must be disclosed before you place the order.

You may request cancellation of an unshipped presale or preorder item by emailing support@atlst.com with your order number and checkout email. Eligible unshipped cancellations receive a full refund to the original payment method, including applicable taxes and shipping charges. No return shipping fee applies.

Any self-service cancellation option, if available, has a 15-minute request window after order placement. If that option is unavailable or the window has passed, email us. The 15-minute online window does not prevent an eligible cancellation request by email before shipment. If an item has already shipped, the return process applies.

If we cannot ship within the stated timeframe, we will contact you with an updated estimate and the option to accept the delay or cancel the affected unshipped items for a prompt refund, including applicable shipping charges. We will obtain any required consent. If required consent is not received, we will cancel and promptly refund the affected items. See our Shipping Policy and Return & Refund Policy for details.

7. Shipping and Delivery

Economy shipping is free, with no minimum purchase, for website orders within our supported delivery area. Optional Express shipping is $19.95 where available at checkout, with estimated delivery within two business days after dispatch. Express does not shorten processing time or a presale or preorder waiting period. Business days exclude weekends and holidays.

Delivery estimates depend on readiness to ship, destination, and carrier service. Weather, holidays, and carrier disruptions may affect transit. These estimates do not waive our obligations if we cannot ship within a promised timeframe. Please provide an accurate delivery address and contact us promptly about corrections, delayed or missing packages, or damaged deliveries. Our Shipping Policy explains the applicable process.

8. Returns, Refunds, and Exchanges

Our Return & Refund Policy governs eligible returns, exchanges, quality concerns, and refunds. Standard eligible returns must be requested within 30 days of the item’s delivery. Items must meet the condition requirements in that policy; opening packaging solely to inspect a blanket does not by itself make it ineligible.

A $14.95 return shipping fee per standard return, plus applicable tax on that fee, is deducted from the refund. We provide the return label and charge no restocking fee. The fee is waived for approved damaged, defective, or incorrectly shipped items. It does not apply to cancellations of unshipped presale or preorder items.

Refunds are issued to the original payment method, subject to the deductions and exceptions in the Return & Refund Policy. Optional Express charges are not refunded for change-of-mind returns except where required by law. Exchanges depend on availability. Holiday extensions and the process for quality concerns after use are described in the policy. The return terms in effect when you place your order apply to that order.

9. Account and Checkout Information

Keep your contact, billing, and delivery information current and accurate. You are responsible for protecting your account sign-in access and for activity you authorize through your account. Contact us promptly if you believe someone has accessed your account without permission. We will handle account-security concerns in accordance with applicable law and our Privacy Policy.

10. ATLST Content and Intellectual Property

Our website design, logos, product photography, descriptions, and other store content belong to ATLST or their respective rights holders. Except as allowed by law or expressly permitted by the relevant owner, you may not copy, sell, republish, or commercially exploit that content or suggest an endorsement that does not exist.

These restrictions do not prevent honest reviews, lawful quotation, ordinary use of sharing features, or other uses protected by law. Buying a product does not transfer ownership of ATLST’s trademarks or other intellectual property.

11. Reviews, Stories, Photos, and Feedback

You retain ownership of content you create. If you choose to submit a review or other content for public display on our website, you give us nonexclusive permission to host, format, and display it in connection with that review or submission. You must have the rights needed to submit the content and must not include another person’s private information without permission.

We will seek additional permission before featuring your story, photo, or video in a separate marketing campaign unless you have already agreed to that use. Simply tagging ATLST on social media does not transfer your ownership rights.

We may moderate unlawful, abusive, irrelevant, privacy-infringing, or clearly false or misleading material. We do not prohibit or penalize honest negative reviews or require customers to give up ownership of their reviews. Separate creator, contest, or licensing agreements may apply when expressly agreed.

12. Shopify and Other Third-Party Services

Our online store is hosted on Shopify. Shopify provides technology that helps us operate the store; your purchase of ATLST merchandise is with ATLST BRANDS LLC. Other providers may support payments, delivery, analytics, communications, or optional website features.

Third-party services and linked websites may have their own terms and privacy practices. We do not control independently operated third-party sites. Review their terms when choosing to use them. This section does not remove any responsibility or consumer protection that applicable law places on ATLST.

13. Privacy

Our Privacy Policy explains how information is collected, used, and shared in connection with the store and your purchases. Please read it alongside these Terms. Separate terms and privacy notices may apply to third-party services you choose to use.

14. Prohibited Conduct

You must not use the site for fraud, unlawful transactions, harassment, impersonation, or infringement of others’ rights; submit materially false account or order information; introduce malicious code; gain unauthorized access; collect others’ personal information unlawfully; or interfere with the website’s operation or security.

This section does not restrict lawful complaints, honest reviews, valid payment disputes, or the exercise of consumer rights.

15. Website Availability and Consumer Warranties

We work to keep our website available and accurate, but do not promise uninterrupted or error-free access. To the extent permitted by law, the website and optional online features are provided on an “as available” basis.

This does not disclaim express product promises, the remedies in our published policies, or warranties and consumer rights that cannot lawfully be excluded. Nothing here makes a product warranty broader or narrower than applicable law or an express warranty separately provided with the product.

16. Liability and Responsibility for Misuse

To the extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential business losses arising from use of the website. This limitation does not exclude liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot lawfully be excluded, or any other responsibility or remedy that applicable law does not allow us to limit.

To the extent permitted by law, you are responsible for reasonable third-party losses and expenses directly caused by your fraudulent or unlawful misuse of the website or infringement of others’ rights. This does not require you to cover our own negligence or wrongdoing or restrict a valid consumer claim.

17. Suspension and Termination

We may suspend or restrict website or account access for fraud, security risks, unlawful conduct, or a material violation of these Terms, as permitted by law. You may stop using the website at any time.

Restricting access does not remove rights or obligations relating to existing orders, valid refunds, or consumer protections. You may still contact support@atlst.com for order assistance. Provisions that by their nature need to continue after use ends will continue to the extent permitted by law.

18. Applicable Law and Consumer Rights

Transactions through our U.S. store are subject to applicable U.S. federal and state law. Nothing in these Terms takes away mandatory consumer protections, remedies, or rights to bring a claim that apply to you. If a term conflicts with a right that cannot legally be waived, that right takes priority.

19. Updates, Policy Priority, and Severability

We may update these Terms by posting a revised version and updated date. Changes apply prospectively. The terms and policies in effect when you place an order govern that order unless a change is legally required or you expressly agree otherwise. We will provide additional notice when required by law.

These Terms, the linked policies, and any specific written agreement or order terms govern the matters they address. A policy that addresses a particular subject more specifically controls that subject, subject always to mandatory law. Failure to enforce a provision once does not waive it. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
